Terms of Service of Safe Horizon LLC

  1. Acceptance of Terms

By accessing and using the services provided by Safe Horizon LLC (“we,” “us,” or “our”) through our website mysafehorizon.com or our mobile application, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

ARBITRATION NOTICE FOR USERS IN THE UNITED STATES: THESE TERMS INCLUDE AN ARBITRATION CLAUSE AND A WAIVER OF RIGHTS TO INITIATE A CLASS ACTION AGAINST SAFE HORIZON LLC. EXCEPT FOR SPECIFIC TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION CLAUSE, YOU AND SAFE HORIZON LLC AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED THROUGH MANDATORY BINDING ARBITRATION, AND BOTH YOU AND SAFE HORIZON LLC WAIVE THE RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

  1. Eligibility

You must be at least 18 years old to use our services. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

  1. Description of Service

Safe Horizon LLC provides internet security services, including educational information, threat assessments, and email security. Access to our services requires a web browser, web application, or mobile application. To use certain features of our service, you must provide a valid email address and, for paid services, valid payment information.

  1. User Registration and Account Security

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.

  1. Privacy Policy

Our Privacy Policy, available at https://mysafehorizon.com/privacy-policy, governs the collection, use, and disclosure of your personal information. Please review it carefully.

  1. User Conduct

User Conduct

As a user of Safe Horizon LLC services, you are expected to use our services responsibly and ethically. By agreeing to these Terms, you commit to the following standards of conduct:

  • No Unlawful or Prohibited Use: You agree not to use the services for any purpose that is unlawful or prohibited by these Terms. You may not use the services in any manner that could damage, disable, overburden, or impair any Safe Horizon LLC server, or the network(s) connected to any Safe Horizon LLC server, or interfere with any other party’s use and enjoyment of any services.
  • No Hacking or Unauthorized Access: You agree not to attempt to gain unauthorized access to any services, other accounts, computer systems, or networks connected to any Safe Horizon LLC server or to any of the services, through hacking, password mining, or any other means. You agree not to obtain or attempt to obtain any materials or information through any means not intentionally made available through the services.
  • No Spamming: You agree not to use the services to send spam or unsolicited messages. You shall not use the services to send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including material harmful to children or violative of third-party privacy rights.
  • Responsible Interaction: You agree to interact with the services and other users with respect and courtesy. This includes refraining from engaging in conduct that is harmful, threatening, abusive, harassing, defamatory, or discriminatory.
  • Compliance with Laws: You agree to comply with all applicable local, state, national, and international laws and regulations in your use of the services.

Violation of any of these standards of conduct may result in immediate termination of your account and access to Safe Horizon LLC services, at our sole discretion, in addition to any legal remedies that Safe Horizon LLC may have.

  1. Intellectual Property Rights

All content on our website, including text, graphics, logos, and images, is owned by Safe Horizon LLC and is protected by copyright laws. You may not use any content from our website without our express written permission.

  1. User Content

You retain ownership of any content you submit to us. By submitting content, you grant us a license to use it for the purpose of providing our services.

  1. Cancellation and Refund Policy

You may cancel your use of the services at any time. Refunds may be issued 

  1. Service Modifications and Interruptions

We reserve the right to modify or discontinue the services at any time without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.

  1. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

  1. Governing Law

These Terms shall be governed and construed in accordance with the laws of Alabama, USA, without regard to its conflict of law provisions.

  1. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on our website.

  1. Dispute Resolution by Binding Arbitration:
  • Agreement to Arbitrate: This section is referred to as the “Arbitration Agreement.” You agree that any and all disputes or claims that have arisen or may arise between you and Safe Horizon LLC, whether relating to these Terms, the services, the use of any product or service provided by Safe Horizon LLC, or otherwise, shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
  • Procedures: The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement. The arbitration will be conducted by a reputable arbitration organization, such as the American Arbitration Association (“AAA”), under its rules and procedures, including the AAA’s Consumer Arbitration Rules (as applicable), as modified by this Arbitration Agreement. The arbitrator must also follow the provisions of these Terms as a court would.
  • Arbitration Costs: Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules.
  • Waiver of Class or Consolidated Actions: All claims and disputes within the scope of this arbitration agreement must be arbitrated or litigated on an individual basis and not on a class basis, and claims of more than one customer or user cannot be arbitrated or litigated jointly or consolidated with those of any other customer or user.
  • Confidentiality: All aspects of the arbitration proceeding, and any ruling, decision, or award by the arbitrator, will be strictly confidential for the mutual benefit of all parties.
  • Severability: If a court or the arbitrator decides that any term or provision of this Arbitration Agreement (other than the subsection titled “Waiver of Class or Consolidated Actions”) is invalid or unenforceable, the parties agree to replace such term or provision with a term or provision that is valid and enforceable and that comes closest to expressing the intention of the invalid or unenforceable term or provision. The remainder of these Terms will continue to apply.
